Article 1 (Application)

These terms set out the conditions for using the REAL SIMONS online store ("this store"), operated by simons Ximen Co., Ltd. ("we", "us"). By using this store you are deemed to have agreed to them.

Article 2 (Formation of an order)

An order is formed when you complete the order process and we send an order confirmation email. However, even after an order is formed, we may cancel it at our discretion in the following cases.

The item turns out to be out of stock
There was a clear error in the price displayed
We judge the purchase to be for the purpose of resale
There has been a past failure to pay or other breach of obligation
The delivery address is inaccurate, or you cannot be reached

Article 3 (About the products)

The products sold in this store are made principally from natural leather. Creases, grain, veining, scars, uneven colour, left–right differences, and dimensional variation between individual pieces (on the order of 1–2 cm) are inherent characteristics of a natural material and are not defects.

Colours in product photographs may look different from the actual item depending on your viewing environment.

Article 4 (Prices and payment)

All prices shown are in Japanese yen and include tax. If you are browsing from outside Japan, prices are shown in US dollars and include shipping. Duties and import taxes are handled as set out in our Shipping Policy.

Payment is limited to the methods shown at checkout.

Article 5 (Delivery and risk)

Title to and risk in the product pass to you when the product is handed over to the carrier.

Shipping on international orders is included in the price. Duties and import taxes may either be covered by us or charged to you when your parcel arrives, depending on the destination country and the shipping method used. Where a charge is raised, it is payable by you. If a parcel is returned because delivery was refused or nobody was available over a long period, the shipping actually incurred and any duties are payable by you.

Article 6 (Returns and exchanges)

Returns and exchanges are governed by our separate Returns & Exchanges policy.

Article 7 (Intellectual property)

Copyright and trademark rights in all product images, text, logos, designs, and other content published in this store belong to us or to the rightful owner. Reproduction, republication, alteration, and commercial use without permission are prohibited.

Article 8 (Prohibited conduct)

In using this store, you must not do any of the following.

Acts contrary to law or public order and morals
Acts infringing the rights of us or of a third party
Acts obstructing the operation of this store
Registering false information
Purchasing for resale or other commercial purposes

Article 9 (Limitation of liability)

We are not liable for loss arising from natural disaster, communication line failure, causes attributable to payment providers or carriers, or other causes not attributable to us.

Any damages we are liable for are capped at the purchase price of the product concerned and do not include lost profit or other indirect loss.

Article 10 (Governing law and jurisdiction)

These terms are governed by Japanese law. In the event of a dispute concerning this store, the Tokyo District Court shall have exclusive jurisdiction in the first instance.
